The present terms and conditions are the general conditions of use of the Galerie du 9e Art website accessible at https://www.galerie9art.fr and which every user expressly accepts and undertakes to respect for any order.

Any customer, before any acquisition or any order, validates the present general conditions of sale by af fixing a mark in the box provided for this purpose.

The Galerie du 9e Art reserves the right to reject any order or purchase that does not comply with these contractual provisions.

The general conditions, in reference, are subjected to the French legislation and any disputes which would result from their implication remains of the competence of the French jurisdictions.




Online reservation


1. The reservation


Reservations are made and retained by the Gallery after acceptance of these general terms and conditions of sale by the client. The buyer, who wishes to reserve a product must
‐ fill in the identification form on which they will indicate all the requested details,
‐ validate his reservation after having checked it and precisely indicate the delivery address of the piece hoped for;
‐ for certain exhibitions, or in the case of certain original works, the Galerie du 9e Art can impose before the acceptance of a reservation, the obligation to make a partial payment of a minimum percentage of 20% of the total price, as a deposit, by one of the means proposed by the site: Bank transfer, cheque.


After the reception of the deposit, the Galerie du 9e Art will confirm the reservation by e-mail. Any reservation without the payment of the deposit within 48 hours will be cancelled.


The payment of the deposit for a reservation remains definitively acquired by the gallery even in the case of cancellation of the order after the 7 days legally foreseen, any cancellation will be valid only by reception of a registered letter with acknowledgement of receipt.



2. Modification of the reservation


Any request for modification of a reservation remains possible, but must be requested by writing to the Galerie du 9e Art at the following e-mail address: contact@galerie9art.com or by mail at 4 rue Cretet, 75 009 Paris, and requires a written agreement from the gallery as a response.


After the Gallery has received the full payment, the sale becomes final and therefore no modification will be accepted, except on a case by case basis by decision of the Gallery.



3. Cancellation of the reservation and purchase


In accordance with article L 121-20 of the French Consumer Code, the buyer has a period of 7 days (seven days) starting from the con firmation of the reservation made by the payment of the partial price of 20% of the total price to indicate his withdrawal resulting in a refund of the amount paid.


After this period of 7 days has passed, no cancellation will be accepted with a full refund, and the 20% deposit will be kept by the Gallery.



Shipping and Delivery


Shipping and delivery times


The Gallery uses the DHL's services, declared value. The customer, at his wish, can ask for another shipping service at his expense and risk.
The shipment of the works is made upon full receipt of the payment and the shipping costs, which are at the sole charge of the customer. Taking into account the preparation time, the shipping time is at least 10 working days. If the work is part of an ongoing exhibition, it will be sent at the end of the exhibition. To this shall be added the delivery time of the carrier (DHL/carrier).


In accordance with Article 28 of the Loi Châtel (Article L. 121-20-3 paragraph 1 of the French Consumer Code), the Site indicates a delivery deadline that can be consulted before the contract is concluded. In general: the delivery period will be 21 days with the possibility of an extension in the context of an exhibition extension.



General shipping costs and other taxes


‐ The various taxes applicable according to the territory in which the client is domiciled are and remain exclusively attributable to the client-buyer, which he accepts as soon as the reservation is made.
‐ The shipping and insurance costs related to the delivery are fixed by the Galerie du 9e Art according to the value of the order and are fully charged to the customer.


The Galerie du 9e Art will not make false statements or a truncated description of the item in order to reduce or eliminate any customs clearance fees or local taxes.



Delivery problems


It is the buyer's responsibility to check the condition of the package upon delivery and to refuse the delivery to DHL if the package is damaged or broken.


If the original packaging is damaged, torn or open at the time of the delivery, you must check the condition of the items. If they have been damaged, you must refuse the parcel and write the reason(s) on the delivery note (parcel refused because opened or damaged). You must check the conformity of the goods delivered at the time of delivery and before signing the carrier's delivery note. You must indicate any anomaly concerning the delivery on the delivery note and in the form of a handwritten reservations accompanied by your signature. This veri fication is considered to have been carried out once the buyer, or a person authorised by him, has signed the delivery note.


Any package accepted is considered "as accepted". The acceptance of the parcel by a buyer purges the Galerie du 9e Art of any responsibility.


In order to obtain a refund of the articles, the buyer must inform us of any problem observed on the day of delivery or at the latest on the next working day following delivery, by sending us a message to contact@galerie9art.com. The buyer must give a detailed description of the problem (e.g. damaged package, already opened,...). No refund of the shipping costs will be made by the gallery to the customer if the package is damaged or if it arrives late. DHL is responsible for these refunds.



Force majeure


The Galerie du 9e Art cannot be held responsible for the non-execution of the contract concluded or of a purchase, caused by an event having a character of force majeure or fortuitous case.

Please note: in order to facilitate the processing of your requests, please ensure that you provide your name and email address as well as the reference number of your reservation. Terms of payment


The prices appearing on the internet site are prices including all taxes in euro, taking into account the VAT that is in effect during the day of the reservation; any change of the rate could be re flected on the price of the products or the services.


The Galerie du 9e Art reserves the right to modify its prices at any time, however, that the price appearing on the website on the day of the reservation will be the only one applicable to the buyer.


The total price of any reservation can be paid in several instalments by the buyer during the year.


The payment can be made by:
‐ Cheque :
The reservation will then be effective for 15 days. After this period, without the reception of the cheque, the reservation will be cancelled. The reservation will only be validated upon reception of the cheque and after validation. The piece will only be sent once the cheque has been received.
The cheque should be made out to : Galerie du 9e Art.
‐ Bank transfer :
The order will be reserved for 15 days. After this period, without validation of the transfer with the banking institution, the order will be cancelled. The order will only be processed once the transfer has been validated. The transfer must be accompanied by the order number and the name and the email of the customer.
‐ Credit card :
Payment by credit card is only available at the physical gallery and with card insertion (no contactless). The gallery also does not accept American Express cards.
‐ Cash :
A private individual, not acting in the course of a professional activity, may pay in cash up to 1,000 euros. This limit is increased to €15,000 if their tax residence in not France.


A professional may not pay more than 1,000 euros in cash in the context of their activity, whether or not their domicile is listed in France.


The Galerie du 9e Art does not accept payment via PayPal


The Galerie du 9e Art controls all reservations made on the site. A confirmation email is sent to you within 3 working days after the reservation by the gallery staff. No payment by Internet (except bank transfer). In the context of payments, we may ask you to provide all the necessary documents to release your reservation.



Invoice


The invoice, once the piece paid, will be sent by email or on paper in addition to the reservation.



Default of payment


The Galerie du 9e Art reserves the right to refuse to make a delivery or to honour a reservation from a consumer who has not paid in full or in part for a previous reservation or with whom a payment dispute is pending.


In case of three reservations consecutively cancelled by a customer, the Galerie du 9e Art reserves the right to refuse a new reservation.



Intellectual property


Art.3 (French law): All images, illustrations and works presented or reproduced on the site are strictly protected by copyright and the intellectual property code in France, Europe and worldwide. Any reproduction or representation, in whole or in part, of the images or of the galerie9art.com website is strictly forbidden.
Each author whose works are presented, exhibited or reproduced on the site galerie9art.com retains full and complete ownership of their copyright, including after the purchase of one of their works.

The website www.galerie9art.com and each of its components (its tree structure, logos, graphics, texts, photos, images of the original p, etc.) are governed by French legislation, particularly those relating to copyright, databases and intellectual property.
Any unauthorised reproduction, representation, publication, transmission or, more generally, any unauthorised use of the site and/or its elements is liable to legal action.



Collection and use of data


Personal information may be requested when registering for the newsletter or creating a customer account. Some information requested in the forms is mandatory. We undertake not to sell or communicate this information to third parties without the customer's prior consent.



Rights of access, modification and deletion of personal data


All personal information is subject to a right of access, rectification and withdrawal.
The exercise of these rights will be done in compliance with the conditions provided for by the modi fied law 78-17 of January 6, 1978 (French law) and its application decrees relating to "data processing, files and freedoms", by making a request directly by contacting the company by mail at Galerie du 9e Art, 4 rue Cretet 75009 Paris or by sending an e- mail to contact@galerie9art.com.
